1. Objeto

Los presentes Términos de Uso regulan el acceso, consulta, descarga, preservación, reutilización e interoperabilidad de los contenidos disponibles en el Repositorio Institucional de Tesis de la Universidad Virtual de Estudios Superiores, UNIVES.

El Repositorio tiene como finalidad preservar, difundir y facilitar el acceso abierto a tesis de licenciatura, maestría y doctorado autorizadas expresamente por sus autores para publicación digital.

2. Definiciones

Para efectos de estos Términos se entenderá por:

  • Repositorio: plataforma digital institucional destinada a alojar, preservar, describir, difundir e interoperar tesis autorizadas.
  • Tesis: obra académica presentada para la obtención de un grado académico en UNIVES.
  • Autor: persona física que elaboró la tesis y conserva los derechos morales correspondientes.
  • Usuario: cualquier persona que acceda, consulte, descargue o reutilice contenidos del Repositorio.
  • Licencia: autorización pública que establece condiciones de uso de una tesis.
  • Metadatos: información descriptiva, técnica, administrativa y jurídica asociada a cada tesis.

3. Alcance

Los presentes Términos aplican a toda persona que acceda al Repositorio, sin importar su ubicación geográfica, perfil académico o finalidad de consulta.

El acceso al Repositorio no implica transferencia de derechos patrimoniales, cesión de derechos ni autorización para realizar usos distintos a los expresamente permitidos.

4. Condiciones de acceso

El acceso al Repositorio será público, gratuito y preferentemente sin necesidad de registro. UNIVES podrá implementar medidas técnicas de seguridad, control de tráfico, verificación de uso legítimo o restricción temporal cuando sea necesario para proteger la disponibilidad, integridad o seguridad del servicio.

5. Derechos de autor

Las tesis publicadas en el Repositorio son obras protegidas por la legislación mexicana en materia de derecho de autor. Los derechos morales corresponden a sus autores y deberán ser respetados en todo momento.

Salvo pacto expreso en contrario, los derechos patrimoniales permanecerán en sus titulares. La publicación en el Repositorio no constituye cesión de derechos patrimoniales a favor de UNIVES ni de terceros.

6. Autorización de publicación

UNIVES publicará únicamente tesis respecto de las cuales exista autorización expresa, previa y documentada del autor o titular correspondiente.

Mediante dicha autorización, el autor permite a UNIVES alojar, reproducir técnicamente, comunicar públicamente, preservar, respaldar, migrar de formato, indexar e interoperar la tesis para fines académicos, institucionales, documentales y de acceso abierto.

Esta autorización será no exclusiva, gratuita y aplicable en medios digitales, salvo que el formato autorizado establezca condiciones adicionales.

7. Licencia de uso

Las tesis publicadas en el Repositorio Institucional de Tesis de la Universidad Virtual de Estudios Superiores (UNIVES), salvo que se indique expresamente una licencia distinta en el registro correspondiente, se distribuyen bajo la licencia Creative Commons Atribución-NoComercial-SinDerivadas 4.0 Internacional (CC BY-NC-ND 4.0).

En consecuencia, cualquier usuario podrá:

  • consultar las tesis libremente;
  • descargarlas;
  • copiarlas y redistribuirlas por cualquier medio o formato;
  • utilizarlas con fines académicos, docentes, científicos o personales;

siempre que:

  • se reconozca adecuadamente la autoría;
  • se cite la fuente original;
  • se conserve el aviso de la licencia;
  • no exista finalidad comercial;
  • no se distribuyan versiones modificadas de la obra.

En caso de existir contradicción entre el presente documento y la licencia Creative Commons correspondiente, prevalecerá el texto oficial de la licencia respecto de los derechos y obligaciones derivados de ésta.

8. Usos permitidos

Los usuarios podrán:

  1. consultar tesis en línea;
  2. descargar tesis para uso personal, académico, docente o de investigación;
  3. imprimir ejemplares para uso personal o académico;
  4. citar fragmentos conforme a buenas prácticas académicas;
  5. compartir enlaces al registro institucional;
  6. redistribuir la tesis íntegra, sin modificaciones, sin fines comerciales y con atribución;
  7. realizar análisis académico no comercial, siempre que no se vulneren derechos de autor, datos personales, seguridad del sistema o condiciones de licencia.

9. Usos prohibidos

Queda prohibido:

  1. atribuirse total o parcialmente la autoría de una tesis;
  2. plagiar, alterar, mutilar o manipular el contenido;
  3. comercializar tesis descargadas del Repositorio;
  4. vender compilaciones de tesis sin autorización;
  5. eliminar datos de autoría, licencia o procedencia;
  6. distribuir versiones modificadas como si fueran oficiales;
  7. cargar tesis en plataformas comerciales sin autorización;
  8. usar el Repositorio para fines ilícitos;
  9. realizar extracción masiva de archivos mediante bots, scraping o herramientas automatizadas no autorizadas;
  10. afectar la disponibilidad, seguridad o integridad tecnológica del Repositorio;
  11. utilizar contenidos para entrenamiento comercial de modelos de inteligencia artificial sin autorización expresa del titular correspondiente.

10. Inteligencia artificial, minería de textos y uso automatizado

UNIVES podrá permitir la minería de textos y datos con fines académicos, científicos o docentes no comerciales, siempre que se respeten las licencias, los derechos de autor, la privacidad, las medidas técnicas del sitio y las condiciones de acceso razonable.

El uso de tesis para entrenamiento, ajuste, comercialización o integración en sistemas de inteligencia artificial con fines comerciales requerirá autorización expresa de los titulares de derechos correspondientes.

UNIVES podrá limitar, bloquear o suspender accesos automatizados que comprometan la seguridad, integridad, disponibilidad o desempeño del Repositorio.

11. Citación académica

Toda reutilización académica deberá citar adecuadamente la tesis. Se recomienda el siguiente formato general según APA 7:

Apellido, N. N. (Año). Título de la tesis [Tesis de licenciatura/maestría/doctorado, Universidad Virtual de Estudios Superiores]. Repositorio Institucional de Tesis UNIVES. Identificador o enlace permanente.

12. Metadatos e interoperabilidad

UNIVES podrá publicar y compartir metadatos de las tesis para fines de descubrimiento, indexación, preservación, interoperabilidad, estadísticas académicas y vinculación con sistemas nacionales o internacionales de información científica.

La cosecha de metadatos podrá realizarse mediante protocolos técnicos autorizados, tales como OAI-PMH, API institucional o mecanismos equivalentes. La autorización de cosecha de metadatos no implica autorización para extracción masiva de archivos completos.

13. Preservación digital

UNIVES podrá realizar copias técnicas, respaldos, migraciones de formato, verificaciones de integridad, normalización de archivos, generación de miniaturas, extracción de texto, asignación de identificadores y demás acciones necesarias para la preservación digital de las tesis.

Estas acciones no se considerarán modificación sustantiva de la obra, siempre que tengan finalidad técnica, documental o de conservación.

14. Retiro excepcional de contenidos

UNIVES podrá retirar, suspender o restringir temporal o definitivamente una tesis cuando:

  1. se detecte falta de autorización;
  2. exista reclamación fundada por derechos de autor;
  3. se identifique exposición indebida de datos personales;
  4. exista orden de autoridad competente;
  5. se advierta plagio, falsedad o infracción grave;
  6. exista error material en el archivo publicado;
  7. el autor presente solicitud fundada y jurídicamente procedente.

El retiro de una tesis no necesariamente implicará eliminación de metadatos, salvo que existan razones legales o institucionales para ello.

15. Responsabilidad del autor

El autor declara, mediante el formato correspondiente, que la tesis es de su autoría o que cuenta con las autorizaciones necesarias respecto de materiales de terceros incluidos en ella.

El autor será responsable por reclamaciones derivadas de plagio, uso indebido de obras de terceros, datos personales no autorizados, información confidencial o cualquier infracción atribuible al contenido de la tesis.

16. Responsabilidad del usuario

El usuario será responsable del uso que haga de las tesis, metadatos y materiales disponibles en el Repositorio. El incumplimiento de estos Términos podrá dar lugar a restricciones de acceso y a las acciones legales que correspondan.

17. Exclusión de responsabilidad institucional

UNIVES no garantiza que los contenidos estén libres de errores académicos, metodológicos, técnicos o de interpretación. Las opiniones, conclusiones y contenidos de cada tesis son responsabilidad de sus autores y no representan necesariamente la postura institucional de UNIVES.

UNIVES no será responsable por usos indebidos realizados por terceros, sin perjuicio de que podrá adoptar medidas razonables para prevenir, atender o corregir infracciones reportadas.

18. Protección de datos personales

El tratamiento de datos personales relacionado con el Repositorio se regirá por el Aviso de Privacidad correspondiente, conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares y demás disposiciones aplicables.

UNIVES procurará publicar únicamente los datos académicos necesarios para la identificación, citación, preservación y difusión de las tesis.

19. Disponibilidad del servicio

UNIVES procurará mantener disponible el Repositorio; sin embargo, podrá suspender, modificar, actualizar o interrumpir temporalmente el servicio por mantenimiento, seguridad, actualización tecnológica, caso fortuito, fuerza mayor o causas institucionales justificadas.

20. Modificaciones

UNIVES podrá modificar los presentes Términos de Uso para atender cambios normativos, tecnológicos, institucionales o de buenas prácticas. Las modificaciones serán publicadas en el sitio del Repositorio y surtirán efectos a partir de su publicación, salvo disposición distinta.

21. Legislación aplicable

Los presentes Términos se interpretarán conforme a la legislación mexicana aplicable, especialmente en materia de derecho de autor, protección de datos personales, responsabilidad civil, educación superior y medios electrónicos.

I. Objeto del Anexo

El presente Anexo incorpora, para efectos exclusivamente informativos y de consulta, el texto jurídico oficial de la licencia Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International Public License (CC BY-NC-ND 4.0), bajo la cual se publican, como regla general, las tesis autorizadas para su difusión en el Repositorio Institucional de Tesis de la Universidad Virtual de Estudios Superiores (UNIVES).

La inclusión de este Anexo tiene como finalidad facilitar a los usuarios la consulta de las condiciones jurídicas aplicables a la reutilización de las tesis, sin necesidad de acceder a fuentes externas.

La licencia es administrada por Creative Commons Corporation y constituye un instrumento jurídico independiente de los presentes Términos de Uso. En consecuencia, su interpretación y alcance corresponden al texto oficial emitido por dicha organización.

En caso de actualización o sustitución oficial de la licencia por parte de Creative Commons, UNIVES podrá actualizar este Anexo conservando la versión aplicable a las obras previamente publicadas, salvo disposición expresa en contrario.

     portion of the contents of the database for NonCommercial purposes
     only and provided You do not Share Adapted Material;

  b. if You include all or a substantial portion of the database
     contents in a database in which You have Sui Generis Database
     Rights, then the database in which You have Sui Generis Database
     Rights (but not its individual contents) is Adapted Material; and

  c. You must comply with the conditions in Section 3(a) if You Share
     all or a substantial portion of the contents of the database.

For the avoidance of doubt, this Section 4 supplements and does not
replace Your obligations under this Public License where the Licensed
Rights include other Copyright and Similar Rights.


Section 5 -- Disclaimer of Warranties and Limitation of Liability.

  a. UNLESS OTHERWISE SEPARATELY UNDERTAKEN BY THE LICENSOR, TO THE
     EXTENT POSSIBLE, THE LICENSOR OFFERS THE LICENSED MATERIAL AS-IS

Section 6 -- Term and Termination.

  a. This Public License applies for the term of the Copyright and
     Similar Rights licensed here. However, if You fail to comply with
     this Public License, then Your rights under this Public License
     terminate automatically.

  b. Where Your right to use the Licensed Material has terminated under
     Section 6(a), it reinstates:

       1. automatically as of the date the violation is cured, provided
          it is cured within 30 days of Your discovery of the
          violation; or

       2. upon express reinstatement by the Licensor.

     For the avoidance of doubt, this Section 6(b) does not affect any
     right the Licensor may have to seek remedies for Your violations
     of this Public License.

  c. For the avoidance of doubt, the Licensor may also offer the
     Licensed Material under separate terms or conditions or stop
     distributing the Licensed Material at any time; however, doing so
     will not terminate this Public License.

  d. Sections 1, 5, 6, 7, and 8 survive termination of this Public
     License.


Section 7 -- Other Terms and Conditions.

  a. The Licensor shall not be bound by any additional or different
     terms or conditions communicated by You unless expressly agreed.

  b. Any arrangements, understandings, or agreements regarding the
     Licensed Material not stated herein are separate from and
     independent of the terms and conditions of this Public License.


Section 8 -- Interpretation.

  a. For the avoidance of doubt, this Public License does not, and
     shall not be interpreted to, reduce, limit, restrict, or impose
     conditions on any use of the Licensed Material that could lawfully
     be made without permission under this Public License.

  b. To the extent possible, if any provision of this Public License is
     deemed unenforceable, it shall be automatically reformed to the
     minimum extent necessary to make it enforceable. If the provision
     cannot be reformed, it shall be severed from this Public License
     without affecting the enforceability of the remaining terms and
     conditions.

  c. No term or condition of this Public License will be waived and no
     failure to comply consented to unless expressly agreed to by the
     Licensor.

  d. Nothing in this Public License constitutes or may be interpreted
     as a limitation upon, or waiver of, any privileges and immunities
     that apply to the Licensor or You, including from the legal
     processes of any jurisdiction or authority.
